These Terms of Service ("Terms") form a binding agreement between you and Booked & Paid Service ("we", "us", "our") and govern your access to and use of our web application, marketing website, APIs, and related services (collectively, the "Service"). By creating an account or using the Service you accept these Terms in full.
1. Eligibility and account
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for the accuracy of the information you provide and for keeping your credentials secure.
- You are responsible for all activity that occurs under your account.
2. Your content
You retain all rights in the data, files, images, client information, and other content you submit to the Service ("Customer Content"). You grant us a limited, worldwide, non-exclusive license to host, store, transmit, display, and process Customer Content solely to provide, secure, and improve the Service on your behalf.
You represent that you have all rights and consents necessary to upload Customer Content and that it does not infringe any third-party rights or applicable law.
3. Subscriptions and billing
- Paid plans renew automatically at the end of each billing period until cancelled.
- Fees are billed in advance and are non-refundable except as expressly stated in our Refund Policy or required by law.
- You authorize us and our payment processor to charge your chosen payment method for all applicable fees and taxes.
- We may change pricing with at least 30 days' notice; changes apply at your next renewal.
4. Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others.
- Upload malware, unlawful, defamatory, or deceptive content.
- Reverse engineer, decompile, scrape, or attempt to access the Service in unauthorized ways.
- Resell, sublicense, or provide the Service to third parties outside your own studio without our written consent.
- Interfere with, overload, or attempt to compromise the Service or its infrastructure.
5. Intellectual property
The Service, including all software, designs, trademarks, and documentation, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-transferable, revocable license to use the Service for your internal business purposes during your subscription.
6. Third-party services
The Service may integrate with third-party tools (e.g. email, payments, calendars). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
7. Suspension and termination
You may cancel your subscription at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. On termination, your license ends and we may delete your data after a reasonable retention period.
8. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data.
10. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, and expenses arising out of your Customer Content, your use of the Service, or your breach of these Terms.
11. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes your acceptance.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which we are established, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, unless mandatory local consumer law grants you additional rights.
